Indeed there are alternative images of exactly the same grave already on commons: here is an example of the same grave File:Marseille-Pagnol94.jpg uploaded on commons by a French wikipedian. The previous pictures are not of the same quality as this image. Again since Roger Davies is familiar with La Treille and with wikipedia policy, I will ask him to comment here. • Here at Mathsci's request on my talk page. I suppose the real question here is whether this very simple, very unexceptional, very standard tombstone is an original artistic work for French copyright purposes at all. Per Commons, French intellectual property laws require, among other things, "'a definite artistic character (« un caractère artistique certain »), as opposed to the building being purely functional, and not being part of a series (as is the case in housing development)". Which is precisely the reason why WWI and WWII war graves aren't covered by the French FOP legislation.  Roger Davies ^talk 06:33, 13 May 2012 (UTC)[reply]

• This picture was taken on my behalf. It is of a famous fountain erected in 1871. It is not a panorama. There are thousands of pictures of fountains in France uploaded by wikipedians (see the article Aix-en-Provence for example). • Again, here at Mathsci's request. Apart from the fountain's age (1871?) which puts it well beyond copyright, the question has to be whether this prefabricated muncipal fountain has either originality or "a definite artistic character" (« un caractère artistique certain »). I doubt it as it seems to me the fountain is clearly functional not decorative. French FOP is more limited in its scope than would appears at first sight which is why mass-produced manhole covers or prefabricated municipal street lights or standard traffic signs are not protected by it. • Keep If made in 1871, the fountain is ((PD-US-1923-abroad)), so the photo is free in the United States. It is also very possible that the designer died before 1942, making it free in France. --Stefan2 (talk) 21:22, 13 May 2012 (UTC)[reply]
