I was under the impression that photos taken in New Zealand prior to 1 January 1965 were public domain in New Zealand. This photo is from 1962. Does this not, therefore, qualify as a free use file? Kiwichris (talk) 05:55, 17 March 2015 (UTC)[reply]

That's only the case with photographs with anonymous photographers (copyright term: 50 years from publication). Other photographs are copyrighted for 50 years from the death of the photographer. The source you have given does not indicate whether the photographer is anonymous or not, so we will have to assume that the photographer isn't anonymous. The website seems to have taken the image from some unspecified source, where the photographer's name might be indicated.

In order to show that the photograph is in the public domain in the United States, you will have to show that the photographer died more than 50 years before 1996, or that the photographer is anonymous and that the photograph was published more than 50 years before 1996. The "constructive purpose" for deletion is, consistent with our image use policy and non-free content policy, we try to minimize the amount of content that we are using under a claim of fair use. A 3-D promo photo of a product is less preferable than a logo or a user-created photo because it requires us to use more copyrighted content. And besides, this article is about the Country Crock brand in general, not about the tub of butter product.
