It was then tagged with ((di-dw no license)) a week ago, but I declined it on procedural grounds per WP:WW. I don't remember it previously being deleted... But I do remember there was something about the rights three years ago. I'm the guy who took the photograph for demonstrative purposes for the DJMax Portable Black Square article. The intention was also to use it to demonstrate what kind of artistic stuff in-general these DJMAX Limited Collector's Edition packages tend to have in DJMAX article but another image was used instead. In my opinion the image should be OK to use since I've given up my rights for it. And the covers presented in the image should be within the fair use case. The deletion log (linked above) shows that I deleted the file in March 2012, then restored by User:Sphilbrick in May of that year. I am not doubting your claim that you took the picture. The concern stems from the fact that the artwork in the picture is a derivative work; the rights of the artists of these covers do not dissipate as a result of your picture. — ξ^xplicit 05:04, 9 October 2015 (UTC)[reply]

I don't remember the exchange, but I checked the back and forth and see that the person was trying to use an NC iicense.That was eventually dropped, and I should have moved on to the copyright of the underlying items, but did not. Unless there's a de minimus argument (seems unlikely) I was fine with the permission for the photo, but should have pushed for evidence of a license of the underlying images. I sent a followup email to the person, explaining the situation. I haven't yet removed the OTRS tag, pending a response, but I agree there is a problem with the derivative rights, so not opposed to a deletion. I haven't dealt with a fair use argument such as this.
