  • I have every reason to believe that this is a non-copyrighted, commercially produced product that is not a work of art. There is no plaque there, giving credit to an artist, naming it or any of the things you'd typically see for a sculpture or work of art. Do you have any evidence that this is a copyrighted work? Also, something can definitely be commercially produced and copyrighted. Again, there is no attribution, naming or anything typically found with art. There is nothing to indicate that this is anything more than a decoration, no different that a clock on the wall or a trophy you won for the 3rd grade spelling bee. It isn't proving a negative. You are proving it's status as free, a positive. Graffiti can be copyrighted, depending on if it is art or a single word or two. Decorations can be copyrighted depending on it. That clock on the wall can be copyrighted. Everything is not automatically copyrighted. If it was, you wouldn't have to say "depending on it" or "in some cases". Either everything is automatic or it isn't. Providing an example of an "iconic clock" being copyrighted doesn't negate the fact that most clocks hanging on the wall are not copyrighted. There is no copyright here. You just keep repeating "it is" and then say everything is, followed by a list of exceptions and disclaimers. *Ok, let me try to explain this a different way. The eagle is not a work of art on display. It is simply a component of a larger display, which is the fountain. It is a decoration on the fountain. If we have a tree decorated for Christmas, the lights don't automatically become copyrighted because they are on display decorating the tree. Nor does the little angel on top. They are decorations, adorning an existing thing. If you made any claim, it would be better made for the fountain as a whole, not a narrowly focused component of it. I don't know if it is copyrighted or not. I'm listing reasons why a court may find it to be copyrighted. You make good points and you never know what a court may say. You are arguing that it is PD because it is not original enough, which is subjective. Some objective things you can prove, are if it was made before 1977 I think the date is because there is no copyright notice, or the maker (or whoever paid the maker) released it under a free license. However, nobody can 100% prove that it isn't original enough because it is subjective. I could definitely be wrong and you could be right, or vice versa. Decorations on a Christmas tree are de minimis. If you take a photo of a Christmas tree, you're fine. If you zoom in on one ornament that was made since 1978, you're not fine. The only way the photo of this statue can be used is if either (a) it is not copyrighted due to age and failure to comply with the formalities, (b) it is an identical reproduction of an eagle that was out of copyright, or (c) we have the permission of the copyright holder. --B (talk) 15:46, 16 May 2013 (UTC)[reply]

  • I keep telling you, it's not really a sculpture. It's just a commercially purchased decoration. This wasn't a piece of artwork commissioned by anyone. It is a purchase made by government agency, using tax dollars, for public use. It was received by the government in the course of their official function.
