(1) This photograph is already hosted at File:Lunch-atop-a-skyscraper-c1932.jpg under fair use for 1x use on its corresponding article Lunch atop a Skyscraper. It was being used at Head for heights but without a corresponding rationale for that article. (I removed it.)

(2) There is not enough information from the uploader on this new version about why this image is acceptable to be uploaded. As a US work c.1932, the license tag ((PD-art)) is not appropriate given that logically the photo was not published before 1923. The photographer is cited everywhere as being Charles Clyde Ebbets (Alabama, 1905-1978), which means on a first glance without digging further about registrations, renewals, etc, this would be in copyright until 2048. seb26 (talk) 03:49, 29 October 2017 (UTC)[reply]
