No. It absolutely fulfilled fair use as captioned here until another editor changed the caption text. The image shows a 2011 attempt to change Superman's iconic costume. Any difference from the iconic costume is notable and having an example of one of the very, very, very rare deviations from Superman's famous costume, is important, and because it involves visual design that would be inadequately described in words, it needs to be illustrated. --Tenebrae (talk) 17:26, 11 December 2015 (UTC)[reply]

The image fulfilled fair use. Its use is essential to the relevant text in the Superman article, per consensus on the talk page. The caption was temporarily changed, which may have led to the questioning of the image's use, however, the original caption has been restored. The notion of this not being fair use was raised by BarryBifford even after the caption was reverted, not for any actual violations against fair use policy, but rather because this user just didn't like the image, as noted in the article's talk page. The screenshot has been used for more than three years, including years of the other copy, according to deletion log. While this surpasses images of subsequent releases, including a Blu-ray release, the trade ad, which is undeleted per my request, should be the infobox image again. The topic is the 25-minute television film/special. Even with the length, the trade ad may have more educational significance than the intertitle screenshot. Non-free album cover art which would seem to be fine in an article about the album itself, but typically it is not used as the primary means of identification about the artist themselves like this image is being used in Cal Massey per WP:NFC#cite_note-2. I realize the Massey died in 1972, so there is probably not a lot of images to choose from, but I'm not sure if a non-free image of the album cover is acceptable even if the person is deceased. The photo used on the cover may be from somewhere else since just the photo is being used here and here. -- Marchjuly (talk) 23:01, 11 December 2015 (UTC)[reply]

I have really tried to find any other images of him. The album cover was a way of being sure that it really was him in the photo. IMO I think that the pics in the links you have provided comes from the album cover and not the other way around, since they are music sites. The article will also contain some info about the album (once I get around to adding it) since its highly unlikely that a stand-alone article about it will be notable enough. So, I thought "one stone, two birds". But are you suggesting that the photo itself, taken from one of the sites, could be used under fair use in the article? Also, apart from the photo, the album design isn't any great artistic work of art (threshold of originality) (See: File:TheBeatles68LP.jpg, File:Backstreet Boys - Black & Blue album cover.png, File:Ebba Grön 1978 - 1982.svg, etc.), but I guess the rules of simple logos may not apply to all album covers. Either the album pic or just a pic is fine by me, as I said above I only thought I'd cover them both with the album pic.
