The result of the discussion was: relicense to ((PD-old-assumed)) and copy to Commons. People seem to frequently forget that this is Files for discussion; not everything nominated here is because the nominator desires deletion of the file. Pursuant to this, OP nominated this here to discuss an appropriate license. The strongest policy-based argument was that this image was created in 1899 (at the latest), which is old enough to assume the author died >70 years ago and thus this image in the public domain. No evidence what the copyright status in Germany is, the most probable country of origin. The file is not a PD worldwide. — Ирука13 15:50, 27 August 2023 (UTC)[reply]

Aware. Does the license on the file description page allow the file to be on Commons? — Ирука13 16:34, 27 August 2023 (UTC)[reply]
No, because as we have established, we don't know the status in Germany. Which is why I uploaded it here instead. I already told you as much yesterday. Why have you nominated it for deletion? Trying to make a WP:POINT is unwise. Parsecboy (talk) 16:36, 27 August 2023 (UTC)[reply]
I didn't ask you if we can upload file to Commons. I asked if the current license template allows this. The current license template allows.
I nominated file for discussion so that we can set up a license template on its description page that matches its license status. — Ирука13 16:54, 27 August 2023 (UTC)[reply]
We have been discussing this on your talk page for some days. You abandoned that discussion because you didn't like the answer you got, then nominated this image for deletion (regardless of what the page is labeled, we know what its purpose is - neither one of us is stupid). That is pretty classic POINTy disruption.
As I stated on your talk page, the current template is perfectly fine. It's been vetted by a number of editors at FAC who know far more about copyright than you (or I). You can safely consider this a settled matter. Parsecboy (talk) 17:30, 27 August 2023 (UTC)[reply]
Where in current license does it say that the file in public domain is only in US? Copy this phrase here, please. — Ирука13
What makes you think it needs to? We are thinking human beings with brains in our heads; we can look at an image, make an educated guess about its country of origin (assuming there is no definitive proof one way or the other), and decide whether an image is best hosted here or on Commons. We don't need programmed boxes to do our thinking for us. Parsecboy (talk) 19:02, 27 August 2023 (UTC)[reply]
Move to Commons and relicense as PD-old-assumed-expired. 1899 is the latest date this photograph was created, and that is over 120 years ago. Abzeronow (talk) 20:35, 29 August 2023 (UTC)[reply]
Relicense to PD-old-assumed-expired and move to Commons, as Abzeronow proposed. It's over 120 years old. The Quirky Kitty (talk) 09:17, 31 August 2023 (UTC)[reply]

There is no information that the image was published somewhere. The years of the photographer's life are unknown. — Ирука13 20:21, 27 August 2023 (UTC)[reply]

I have found information in the article Beck Isle Museum showing that the photographer died in 1958. ("Among the collections are the photography and photographic equipment of Sydney Smith (1884–1958), noted photographer of Pickering."). Considering this is a photo of a football club in Pickering and the watermark on the image matches the name of the Wikipedia article we can be reasonably sure this is the photographer. Though there is still a reasonable chance this was published in some old newspaper before 1928 (and is therefore acceptable for Wikipedia due to US rules) this should not be moved to Commons until 2029 due to 70pma (+1). —Matr1x-101 (Ping me when replying) {user page (@ commons) - talk} 17:19, 31 August 2023 (UTC)[reply]
