Image from Commons now no longer acceptable there moved to en:W as fair use, as it has been used in articles for years. User:Altenmann tagged it as di-disputed fair use rationale. I asked for additional feedback. Altenmann replied [1] "initially i have been vocally objecting to sovied file deletion, but then reconsidered. legal issues aside, please take a look at the post-soviet copyright issue in this way: most soviet people have been robbed by the state "for the good of the whole soviet people" and I see it quite unfair for them to be robbed even symbolically of what's left for whatever other noble slogans." As this seems a somewhat broader concern than a simple template matter, I'm bringing this to wider attention and discussion to see if this can/can't should/shouldn't be used on en:W. -- Infrogmation

• Comment The image on Commons was first kept and then deleted.[2] I believe Commons only allows images not in copyright in the US or the source country whereas here is is only US copyright that is significant. I do not know the status of this image. However, even if the image is in US copyright it seems to me a fair use claim may well be valid.   • Technical explanation: The copy on Commons was originally uploaded in 2006 as "PD-Soviet", but changes in copyright law made that no longer applicable, and no other plausible reason why it would be in the public domain or free licensed was produced. (Wikimedia Commons does not allow "fair use").   • reply the "fair use claim" given for the image is valid, but not admissible: the policy, created after a long and detailed deliberation specifically lists admissible reasons. Surely one may think of hundreds of solid explanation to do what he thinks is right. 'No one objected before' is because there are millions and growing of images in Commons. Coming back after two years I noticed that a big number of sovied pics 'no one objected before' were deleted; I guess, after someone accidentally or systematically reviewed the oldies.
