File has been tagged with ((wrong license)) since March 2016. It is currently licensed as ((Non-free architectural work)), but that does seem incorrect since the TechHaus Volantis is described as a vehicle and not a structure. The question is whether this can be replaced by a freely licensed equivalent per WP:FREER. It seems that cars and other vehicles are generally considered to be utilitarian objects and as such they cannot typically be copyrighted, right? However, this does not really look like a typical vehicle, and there does seem a creative element to it so maybe it needs to be non-free. If it is now permanently installed as a display, it might even be considered to be ((Non-free 3D art)). Should this be treated as replaceable fair use or as some other form of non-free content? -- Marchjuly (talk) 05:18, 11 October 2016 (UTC)[reply]

Possible derivative of non-free content (pins) FASTILY 07:17, 11 October 2016 (UTC)[reply]

This is a photo of an object and is used to illustrate the nature of the collectible pins that are a large part of the National Leadership Skills Conference environment. If it is argued that the image should be removed because it is derivative of non-free content, then it can easily be argued that every photo of a product should be removed under the same logic. For example, File:Kfc taco bell.jpg contains non-free content (the logos). I look forward to your comments. --Steven Williamson (HiB2Bornot2B) - talk ▓▒░ Go Big Blue! ░▒▓ 19:39, 12 October 2016 (UTC)[reply]

Hi Steven. You seem to be arguing that because other similar images exist that this image should be allowed or that it should be all or nothing. That's not really going to get you very far because image use tends to be judged on a case by case basis. If even one of the pins depicted in the photo you took is considered to be still under copyright protection, then that would make this collage-like photo a copyright violation as explained in c:COM:Collages. The shape of the pins may be considered too simple for copyright protection and below the threshold of originality typically used to determine such things, but the designs on their faces most likely are above that threshold. As for the Taco Bell photo you linked to above, the uploader may have considered it to be OK by considering the signage to be part of the building per c:COM:FOP#United States, but that's seems like quite a liberal interpretation in my opinion. The uploader should have also just automatically assumed that the Flicker licensing automatically means that not only the photo itself, but also the object depicted are also free from copyright protection, which is something not always true per c:COM:LL. I will ask about the Taco Bell photo at c:COM:VP/C and see what they say. -- Marchjuly (talk) 01:17, 13 October 2016 (UTC)[reply]
Thank you for your input, Marchjuly. I think my thought process is really that I don't totally understand how a picture that I took with my own camera can be a problem for copyright, if I released it into the PD. I am the copyright holder of the image. From what I understand from your feedback is that it is the individual pins that may be copyrighted and therefore the image is offending the copyright law. If I took a picture the can of Dr. Pepper that is sitting here on my desk and then used it to illustrate a Dr. Pepper, would that image also be a violation? If so, how exactly can you illustrate concepts that can only be represented visually? Wouldn't I be the copyright holder of any photo I take of this Dr. Pepper can on my desk? Thank you very much for your insight. --Steven Williamson (HiB2Bornot2B) - talk ▓▒░ Go Big Blue! ░▒▓ 16:54, 14 October 2016 (UTC)[reply]
Please refer to c:COM:PACKAGING for more specific information about product packaging. Basically you own the rights on the photos you take, but not necessarily the rights of any copyright content depicted within those photos. If you take a photo a can of Dr. Pepper, in which the can is just some object located in the background and is clearly not the focus/purpose of the photo, then de minimis can likely be argued and the copyright of the logo is not relevant. On the other hand, if you take a close up photo of the can's logo for the sole point of showing what the logo looks like and the logo is under copyright protection, then you probably cannot freely license both the photo and the logo unless you created both. The shape of the can is utilitarian, but the labeling/artwork on the can is not. When you buy a can of soda, you purchase the physical contents of the can and the can itself, but you don't purchase the copyright on any of the branding associated with the can.
Back to the Taco Bell photo you mentioned above, I asked about it at c:COM:VP/C#File:Kfc taco bell.jpg and it does seem like such a photo can be freely licensed after all. -- Marchjuly (talk) 23:50, 14 October 2016 (UTC)[reply]

Image is of a current operating airport and was originally uploaded as non-free with a non-free rationale. When challenged as being replaceable, the image was converted to public domain as it was a work o the Indonesian government.

There is no indication on the source site (airport web site), that it is the work of the Indonesian government. Furthermore, per point (b) listed in ((PD-IDGov)) , there are exceptions and in this case, the publishing web site does state "© 2013 - 2016 Bandara Internasional I Gusti Ngurah Rai Bali | Angkasa Pura Airports".
