Uploader is insistent that this image could be an exception to non-free content guidelines. This image fails criteria #1 as it is a copyrighted photo for a living person. The uploader can make his case for keeing it here. -- Whpq (talk) 17:03, 29 July 2015 (UTC)[reply]

I am informed that an administrator will read this. I am requesting immediate deletion of this photo. When I uploaded it, I saw that ted.com, where the photo appeared, did not make their videos totally free, but did make them free for educational purposes. I reasoned that if they did so with their videos, they would also do so with their photos, hence, I uploaded the photo to Wikipedia. I have also had a great deal of personal dealings with the TED organization, and my general sense was that they would make the photo free for educational purposes. But, as I say, it was an educated guess, not a certitude. I now think my reasoning was weak, so, as I say, am requesting deletion. However, I would appreciate if an administrator would speak to the "we want the most attractive photo" argument. I am corresponding with TED and I imagine they will make the photo not totally free, but free for educational purposes, so I believe this issue, of whether it is reasonable to use a photo that is not entirely free but is free for educational purposes and is the most attractive photo of the subject, may arise again. It seems particularly thorny when the photo is of an artist who, by profession, is quite concerned with attractiveness. Thank you. Greg Dahlen, if a free image could reasonably made available, such as when the subject is alive, a fair use image will never be acceptable to depict them, even if is a more flattering photo of the subject. If the subject is concerned about the quality of the photo in their Wikipedia article, they are free do donate a photo that they are the copyright owner of, which would then be in compliance with our policies.--kelapstick(bainuu) 19:44, 29 July 2015 (UTC)[reply]
